Inxeba – Distributor Seeks Urgent Interdict Against The Reclassification Of Film

Following the tardy release by the Film and Publication Board Appeals Tribunal of its reasons for reclassifying the film ‘Inxeba’ (The Wound), the film’s producers, through its attorneys Webber Wentzel, served a law suit on Saturday, 24 February, seeking an urgent interdict overturning the reclassification of the film.

You can read their application here: http://www.indigenousfilm.co.za/wp-content/uploads/2018/02/Complete-Affadavit-INXEBA-Webber-Wentzel-compressed.pdf

The FPB Appeals Tribunal overturned the FPB’s original classification rating of 16 LS and gave the film a rating of X18, classifying the film in the same category as hardcore pornography. The tribunal was chaired by Christopher Mamathuntsha and included Professor AS Magwaza, Nonkoliso Sigcau, Manko Buffel, Lutendo Malada, Sizwe Snail Ka Mtuze, and Lihle Mapipa Ndlovu.

The full report can be read on the FPB website: http://www.fpb.org.za/wp-content/uploads/2018/02/Final-Ruling-Inxeba-The-wound-23-February-2018-1.pdf

Among the reasons for the reclassification, were the Appeals Tribunal’s finding that there was no “scientific, educational and artistic value” in the film. “Since there was no explanation on how the Tribunal reached this specific conclusion, it’s not easy to respond to it,” said producer Cait Pansegrouw. “What I can say is that it would be difficult to argue that our film lacks artistic value, given that it has won 20 awards of excellence internationally and within South Africa. Harvard University, Oxford University, various South African tertiary institutions, and local movements such as Equal Education also have showed interest in including ‘Inxeba’ in their curriculums and programmes.”

Helen Kuun, MD of Indigenous Film Distribution, noted with concern that while Contralesa Gauteng and The Man and Boy Foundation, both of which filed an appeal with the tribunal based on the perceived cultural insensitivity towards the Xhosa initiation tradition, requested a revised rating of 18, the Appeals Tribunal reclassified the film as X18, meaning that it can only be distributed from designated adult premises (sex shops), and forcing the immediate  removal of the film from cinemas.

“We find this ruling sinister, as the ‘X18’ rating was not requested by the appellants, and it cannot be reasonably justified by anyone who has seen the film,” Kuun added. “It is also worrying that the Appeals Tribunal reached this decision without giving the distributor and producer a proper opportunity to make submissions on the matter. This is plainly unlawful.”

Kuun says that the producers and their legal team are awaiting a response to their urgent interdict by Tuesday, 27 February and plan to be in court next week.

In the meantime, the producers and distributor are asking members of the public not to watch, circulate or buy pirated copies of the film. “Please do not support piracy,” says Kuun. “We are working hard to find legal avenues to make the film available to all those who want to see it. Given the current rating of the film, it is also illegal and a criminal offence currently to view it anywhere, on any platform, either free or paid for. We are very encouraged by the support and enthusiasm of fans, but we urge patience while the legal process unfolds.”

The South African Federation Against Copyright Theft (SAFACT) will be instituting legal procedures against any business or individual breaching the intellectual property rights held by ‘Inxeba’. To report piracy send an email to info@safact.co.za

Insights Into Aaudi Arabia At DISCOP Dubai

Just ahead of the start of 2018 edition of DISCOP Dubai, Saudi Arabia has announced a commitment to invest $64 billion in support of the entertainment sector as part of Vision 2030, the social and economic reform program spearheaded by Crown Prince Mohammed bin Salman. The Kingdom looks set to have the fastest growing media sector in the region, if not the world.

But what do Saudi viewers actually watch? The opening keynote presentation at DISCOP Dubai will be made by Dr. Riyadh Naim, CEO of the Saudi Media Measurement Company. SMMC is the only internationally accredited TV people metering service in the MENA region, and gives a unique insight into Saudi viewing habits.

25 Feb 10:15 – 11:00 AM | OPENING KEYNOTE

What TV shows are Saudi Arabia’s 33 million inhabitants watching?

  • What is SMMC and why its data is the only legitimate measure of audience viewing in Saudi Arabia
  • the performance of Arabic productions during Ramadan in particular
  • the performance of international shows (Turkish, American, Indian, Korean, European etc.) throughout the year

Dr. Najm’s opening address will be a must-attend event for any producers planning on taking advantage of what promises to be a massive investment in the sector. He will elaborate on the Saudi population is looking for in TV content, and his insights will prove invaluable in light of the recent reforms and changes taking place within Saudi Arabia.

With a recent ban on commercial cinemas lifted, it is clear that content development will be part of the Saudi government’s investment strategy. As Saudi Arabia’s General Entertainment Authority Chief Ahmed bin Aqeel al-Khatib explains, “In the past, investors would go outside the kingdom to produce their work, and then showcase it back in Saudi Arabia. Today, change will happen and everything related to entertainment will be done here.”

DISCOP Dubai starts tomorrow, February 25th at the Intercontinental Dubai Festival City and more information can be found here: www.discop.com

Which Steps Will The Stars Take To Win Your Vote Live On M-Net This Week? DWTSSA

Make sure you’re ready to support your favourites in Dancing With The Stars SA!

Last week Sunday, M-Net viewers were glued to the very first Dancing With The Stars SA Live Results Show to find out which celebrity and his or her professional dancing partner would be the first to hang up their dancing shoes. Then came the shock:  adorable comedian Ebenhaezer Dibakwane and kykNET soap Suidooster’s Eden Classens were the ones who found themselves heading into a dance-off to persuade the judging panel to save them for the next round.

With Ebenhaezer and his dancing queen, ballroom expert Nombulelo Hlathi taking the final bow, the eleven remaining celebs will show-off their newly-acquired moves this week in the spectacular Dancing With the Stars Extravaganza, live on M-Net 101 between 17:00 and 19:00 on Sunday evening.

Each dancing pair had to master a new dancing style and will have to wow both the show’s panel of four judges as well as the voting public. The judges and voting public have a 50/50 say in determining the ranking of the competitors which determines which two couples have to dance again during the Live Results Show after Carte Blanche at 20:00.

“Remember, if you don’t vote, your favorite may just end up in the dance-off,” says M-Net Channels’  Head of Publicity, Lani Lombard. “It’s possible that there are thousands of viewers out there who were left disappointed last week just because they weren’t registered to vote in time.”

As the voting for Dancing With The Stars SA and the Live Results Show are playing out live on Sunday nights, it’s a prerequisite to be registered as a voter by 16:30 on a Sunday evening. To register, and to vote during the show, simply go to mnet.tv/dwtssa and follow the easy steps.

“It’s a once-off registration and you have 100 votes on the website and on mobile. In other words, 200 in total,” Lombard adds. “You can also vote for more than one pair, if you can’t make up your mind. And be sure to tune in from the start of the show to avoid missing out on a potentially breath-taking performance!”

But with which ballroom style will the celebrities and their professional dancing partners try to step into our hearts?

It’s a Cha Cha Cha challenge for soccer star Delron Buckley and 1Magic actress and TV presenter Thembisa Mdoda, while Eden Classens is hoping to Tango his way back to the top. Then, athletics coach Odessa Swarts and former Miss SA and radio presenter Liesl Laurie have to up the energy to impress the judges with a Quick Step of note.

Former rugby player Thando Manana,  who has become known as the show’s gentle giant, is ready to charm the audience with African Smooth and netball goal shooter Vanes-Mari du Toit  is planning to  sway the public to vote with fabulous Foxtrot.

Also, expect drama deluxe with two stars performing the Paso Doble.  Juanita de Villiers and Zola Nombona are the fiery ladies ready to perform this dance that emulates the movements of a Spanish bullfight.  And, after his surprisingly skillful renditions of the slow waltz and tango, all eyes are bound to be on acting legend Frank Opperman.  This week he has to jive!

For more information on registering to vote head to mnet.tv here. Dancing with the Stars SA is produced for M-Net by Rapid Blue and is sponsored by Lottostar. Join the conversation on the Dancing with the Stars SA Facebook page, or on Twitter and Instagram using the hashtag #DWTSSA.

Tributes Pour In For Idrissa Ouedraogo

Tributes have been pouring in for Burkina Faso filmmaker Idrissa Ouedraogo, who passed away on Sunday, aged 64.

In their obituaries, Variety hailed him as “a towering figure of African cinema’ and The New York Times described him as “legendary,” while on Twitter, Burkina Faso president Roch Marc Christian Kabore said the world had “lost a filmmaker of immense talent,” who “truly contributed to raising the profile of Burkinabe and African cinema beyond our borders… Africa is losing one of its most valuable ambassadors in the field of culture.”

Ouedraogo came to international attention in 1989 with Yaaba (Grandmother), the story of two children who make friends with an old woman who has been outcast as a witch by her village. Yaaba won the FIPRESCI Critics’ Prize and a Special Mention from the Ecumenical Jury  at the Cannes Film Festival, among other accolades.

Other career highlights included 1990’s Tilai (The Law), about a man who returns to his village to discover his father has married the woman he loves, and Samba Traore, about a thief who returns to his village. Tilai won the Grand Prize at both Cannes and FESPACO, while 1992’s Samba Traore won a Silver Bear at the Berlin Film Festival.
